Lokayukta: Definition, Appointment and Structure

What is Lokayukta?

The term Lokayukta might seem intricate, but it is crucial for upholding integrity within the Indian administrative system. In essence, a Lokayukta is a government-appointed official tasked with representing the public's interests, particularly in matters of anti-corruption. The creation of the Lokayukta stems from the Lokpal and Lokayukta Act, 2013, which mandates the establishment of Lokayuktas across various states. This legislation empowers the Lokayukta to investigate corruption allegations against public officials and address related concerns.

 

Appointment of Lokayukta

The Lokayukta and Up-Lokayukta are independent, impartial bodies created to scrutinize the actions and decisions of public officials. These authorities operate separately from the legislative and executive branches, adhering to the same rigorous standards as judges of the Supreme Court and High Court. The Governor appoints them after consulting with both the head of the Opposition in the State Legislative Assembly and the Chief Justice of the State High Court during the selection process.

 

Structure of Lokayukta

The structure of Lokayukta varies across different states. In some states, like Rajasthan, Karnataka, Andhra Pradesh, and Maharashtra, both the Lokayukta and Up-Lokayukta have been established. However, in other states, such as Uttar Pradesh and Himachal Pradesh, only the Lokayukta exists. Jammu & Kashmir, on the other hand, does not have either a Lokayukta or Up-Lokayukta. 

 

For example, the Madhya Pradesh Lokayukta comprises several operational wings, including:

  • Administrative and Enquiry Section

  • Legal Section

  • Special Police Establishment (SPE)

  • Technical Cell
